- MCS act does not have any provisions for not allowing bachelor tenants. Managing Committee has to work as per MCS act.
- General Body or Managing Committee cannot pass a resolution not allowing bachelor tenants in the society.
- Society cannot refuse a member to rent his flat even if he is a defaulter
- Ownership of a flat is with a member and not with society.
- Non occupancy charges are fixed to 10% of service charges. Society cannot charge more non occupancy charges.
